The account is held with the Royal Bank of Canada and is registered under R Jamandas Gordhan with account number 585425-91. This allegation has made its way to the charge sheet of the case opened by Malema against Gordhan on Tuesday.<br />

Land Redistribution In South Africa A Very Thorny Issue That Won't Go Away</h3>

Just days after the ruling party in South Africa, the <a href="http://www.anc.org.za/" target="_blank">African National Congress</a> (ANC) made Cyril Ramaphosa its new country President, the thorny issue of land redistribution is back on the cards.<br />

The ANC elected President Ramaphosa as a country President after it removed Jacob Zuma from the position before his term ended. This came after eight unsuccessful votes of no confidence that were debated in parliament. Zuma survived all of them only to be recalled by his own party.<br />
<br />
Just when he took over the reigns as the country President, Cyril Ramaphosa has assured all South Africans that he will do all in his power to make sure that the issue of <b>land redistribution in South Africa</b> becomes a thing of the past.<br />
<br />
The Economic Freedom Fighters commonly known as the EFF has been pushing for land redistribution without compensation. Since its formation, it leader <a href="http://breakingnewssouthafrica.blogspot.co.za/2014/04/open-letter-to-julius-malema-must-read.html" target="_blank">Julius Malema</a> has called for the ANC to take the issue of land very seriously. He has on a number of occasions explained that without land it will be impossible for the ANC government to effect economic growth.<br />
<br />
More than 80% of land in South Africa is believed to be in the ownership of white people who are refusing to allow government to use it for developmental purposes. Since the ANC came into power in 1994 it has failed to provide housing for those who are homeless. The party blames its failures on the fact that there is no sufficient land in its disposal that can be used to develop housing for the poor.<br />

"We must, given the history we have had, work with urgency to significantly and sustainably escalate the pace of land reform. If we do not do so, this problem that has stayed with us as a nation for hundreds of years will implode in our hands," Ramaphosa told parliament.<br />

Australian Home Affairs Minister has joined the fray and extended invitation to white farmers who may want to relocated to Australia to start farming in that country.<br />
<br />
Dutton was quoted in the Australian media as having said that his government was looking into methods that would facilitate the fast-tracking of visas for white South African farmers who want to relocate to that country.<br />
<br />
Dutton told The Guardian that white South African farmers "deserve special attention" because of the "horrific circumstances" of land seizures and violence in the country.<br />
<br />
South Africa's Minister of International Relations and Cooperation Lindiwe Sisulu wasted no time and issued a diplomatic demarche or warning to Australian High Commissioner in SA Adam McCarthy. Sisulu demands that the comments made by their home affairs minister Peter Dutton, over the SA land redistribution process be retracted.<br />

In February 2015, the Law Society of South Africa (LSSA), which represents all attorneys and speaks nationally on behalf of the attorneys’ profession, convened a colloquium specifically to debate whether the public protector’s findings were legally binding.<br />

The judgment fails to provide guidance to government departments and Parliament on resolving disputes between the public protector and state officials who may have plenary authority over certain matters. Succinctly, the executive and National Assembly were faced with conflicting constitutional duties in Sections 182(1)(b) and 198 respectively.<br />

The strenuous insistence that they could determine for themselves what items were security-related proceeds from their views of their plenary powers under Section 198.

The judgment is remarkably long on the constitutional basis for the powers of the public protector but very short on the constitutional powers of the executive and Parliament when it comes to matters of national security.

The Concourt stated that once Madonsela reported to the National Assembly its constitutional “obligation to take appropriate remedial action” can only mean compliance.

It concludes that when that report was received by the National Assembly, it effectively operationalised the House’s obligations in terms of sections 42(3) and 55(2) of the Constitution.

The Concourt paid scant attention to Section 198 under which Parliament has a superior constitutionally-derived and exclusive authority to determine for itself what are security features at the residence of the president.

South Africa's 2014 election results have started flowing in this morning. The Anc has emerged as a winner even though less than 50% votes have been counted.<br />

Mamphela Ramphele's Agang does not appear anywhere in the results. Her titanic has sunk in deep seas. It is now clear that this self-claimed and renowned academic has got his mathematics all wrong. People of South Africa do not need to have degrees to discern wisely when it comes to elections. <br />

Appearing on TV this morning, Mamphela Ramphele looked exhausted. When she was asked about her party performance she avoided the question but instead commented about hour poorly run elections were. She is certainly bitter.<br />

The DA has also dropped from projections made by the so-called wise analysts. On the other hand the Anc's has gained more strength that the previous elections. It is already projected that it might score a two-third majority.<br />

The Anc had approach the court after the DA sent smses to more than 1.5 million people begging them to vote DA on basis that Zuma had stolen tax payers money. The court found this to be untrue.<br />

The court ordered the DA to send out another SMS through a bulk short message service to all earlier recipients of the first SMS. The order of the court did not end there. It further directed the DA as to how to phrase the sms. “The DA retracts the SMS dispatched to you which falsely stated that President Zuma stole R246m to build his home. The SMS violated the Code and the Act.”<br />

This is yet another set back for the DA as it is struggling to convince many to vote for them. Many people have accused for acting like SA is America where Obama ran his campaign through social media.<br />
<br />
It is not clear whether the DA will have time and enough resources to appeal the decision of the court.<br />
<br />
The court found to justify the publication of the SMS message, the DA had relied on the “licence to loot” phrase in the Public Protector’s report. “Reliance on this phrase is completely misplaced because it ignores the context in which it was used and the fact that President Zuma is not implicated in the ‘licence to loot’ situation,” the judgment reads. “In fact, rather than attributing the excessive costs of the Nkandla project to President Zuma, the report focuses on systematic failures.”<br />

This was after Italy's appeals court upheld a verdict charges of using Luxembourg holding company Gado to dodge paying taxes on royalties of more 1 billion euros ($1.38 billion). Last year's suspended 20 months jail sentence imposed a fine of up to 10 million euros. <br />

Italy's fashion industry has come under spotlight after posting positive results over the last ten years. Even during the recession, the industry continued to do very well. This led to many companies trying to avoid tax on billions of ponds they made. <br />

In a dramatic twist the leader of the DA, Helen Zille, has praised the former leadership of the Anc for the work they have done. This came as a surprise since Zille has been on a witch hunt trying to discredit the Anc and its leadership. <br />

Helen Zille was delivering her keynote address at the Democratic Alliance’s (DA’s) 2014 election manifesto launch in Polokwane on Sunday. She also expressed her disappointment at the fact that the turnout was very disappointing. This was attributed to the fact that the DA does not enjoy support in that province.<br />

"Under presidents Mandela and Mbeki, South Africa made progress. They had a good story to tell. Basic services like water, electricity, sanitation and housing were rolled out. The economy started to grow. Unemployment dropped and many people’s standard of living rose. Measures to fix the injustices of the past were introduced." said Helen Zille.<br />

Kenny Kunene's business partner and Patriotic Alliance President Gayton McKenzie, write an open letter to Economic Freedom Fighters leader Julius Malema.<br />

<b>Dear Julius Malema,</b><br />
<br />
I wronged people in this country two decades ago when I took part in heinous crimes. I have been trying to repay my debt to society for most of the years since. First, by successfully exposing corruption in jail then by speaking to millions of school kids across this country to dissuade them from a life of crime. I am now dedicating my life to Patriotic Alliance, which puts ending gangsterism, but more importantly the conditions that lead to gangsterism in communities, at the top of its agenda. We must get our young people into the mainstream economy.<br />
<br />
I see this open letter as part of repaying my many debts to society. If I did not speak up to warn the people of South Africa, but especially our youth, against you, it would mean I have no love for this country.<br />
<br />
Julius, you and I are not "revolutionaries". We both know that. We both shop at the same Louis Vuitton and Gucci shops. We both have watches worth hundreds of thousands. We wear more money on our wrists than a miner at Marikana will ever hold in his hands. This week you had the audacity to say that you wear Louis Vuitton to "inspire the poor". But the poor get nothing out of you wearing flashy clothes.<br />
<br />
For people like us to call ourselves revolutionaries is an insult to history's real revolutionaries. Patrice Lumumba is rolling in his grave. Thomas Sankara wants to get out of his grave and take back his words that have found their way onto your whisky-swilling tongue. If simply wearing a beret makes you a revolutionary then my mum and all her friends have been revolutionaries for far longer than you.<br />
<br />
You have spent more money at any of your own lavish parties than Kenny Kunene ever did. But Kenny never spent public money. It was his own money that he worked for openly. He never earned his money through misdirected tenders to shady companies that were hard to track. You bankrupted the ANC Youth League. You bankrupted Limpopo. You bankrupted yourself. Now you want to bankrupt what's left of South Africa.<br />

The difference between you and me is that you use politics to take money from the poor. I give money to politics. I am not seeking a position through politics. My name is not even on any list. But you are trying to get to Parliament at all costs. Unlike what you may read about me, I never received any government money. I never received any tenders. I was never a beneficiary in any BEE deal. But you have never worked an honest day in your life to earn your own money. You don't know what that feels like. You don't know what it means.<br />
<br />
When the doors of government's treasury were slammed in your face you went immediately to the poor with your cap in hand, promising them the world, when you needed their money to pay for your tax problems. You are like a man who steals a cellphone and then goes back to his victim to ask for airtime. You exploit our people's genuine hunger for a better life.<br />
<br />
You want to nationalise the mines, but that will take huge amounts of public money to sustain, with no guarantees of profit. You will have to take money that we need right now to build houses and schools for poor people and you will have to gamble with that money to build mines. Nationalisation is not woodwork.<br />
<br />
Will you be the one to look our old women in the eyes and say that they can't have their houses today because you want to invest in mines that will perhaps give us profits in ten years' time? Our minerals will not crawl out of the earth by themselves. And we know that any profits will first have to survive going through your sticky hands before they reach the rest of us.<br />
<br />
Jacob Zuma's Nkandla upgrade was wrong on all fronts. But you also took taxpayers' money to demolish a R3 million house in order to build a R16 million house in Sandton. Your own EFF commissar Andile Mngxitama criticised you for this very thing three years ago. Does he think you are no longer that man? None of us should be that naive.<br />
<br />
You have insulted so many of our people. You insulted MaMbeki. You insulted Baba Buthelezi. You insulted Naledi Pandor. You had to apologise to all of them. Now you have insulted MaKhumalo, Jacob Zuma's first wife. She is a grandmother and you thought it funny to sexualise her and ask us to imagine her in a bathing suit. Is the only old woman who you respect your own grandmother in Seshego? You speak to no one with respect. Anyone who disagrees with you must know that a choice insult is already on its way from you. When the Public Protector went for you, you had nothing good to say about her. When the same Public Protector went for Jacob Zuma and Pansy Tlakula, you hailed her work. How stupid do you think we are?<br />
<br />
Most of your erstwhile comrades in the ANC remain too scared to say anything against you, because they know that they stole with you, right alongside you. You know all their secrets.<br />
<br />
You get two kinds of politicians in this country: the ones who come from prison and those who must still go to prison. You belong to the latter. I may be an ex-thief, but you are a present-day thief. You, particularly you, cannot be calling all white people in this country thieves.<br />
<br />
I have a serious problem with you telling our young people that they must take the mines and take the land. All you can think of in your choice of language is "Take, take and destroy." You are inculcating an attitude of taking instead of contributing and working. Our youth do not need that. No one needs that.Our youth need to be empowered educationally and financially to grow this country.<br />
<br />
You are the modern-day Nongqawuse. There was no one there in 1856 to warn our people against that false prophet. Somebody needs to have the courage to warn us against you. I'm not scared of you. But I am scared of what will happen to this country if our young people don't realise what you are before it is too late.<br />
<br />
For most of my younger years I was surrounded by conmen and thieves. But you are the biggest thief I ever met. You, truly, are the Con-mander in Thief.<br />
<br />
I wish Kenny would take South Africa into his confidence over the real reasons why he left EFF.<br />

The African National Congress has finally picked 7 MPs to join ad hoc committee on Nkandla report. The committee must test President Zuma's submission on the Public Protector's report on Nkandla.<br />
<br />
The committee is set up in terms of the Rules of the National Assembly which allowed parties in parliament 10 day to submit names of members to join it. The Anc has corrected the DA's lies that it was delaying the process. The DA was not aware that parties have 10 days allowance according to the rules.<br />
<br />
Some Anc members have expressed concerned over the fact that the DA does not understand the rules of the parliament yet it want to be a ruling party. <br />
<br />
"In terms of the Rules of the National Assembly, parties were afforded 10 working days to recommend names to the Speaker for appointment to the ad hoc committee," said ANC chief whip, Stone Sizani.<br />
<br />
"As we have repeatedly stressed, this ad hoc committee is being established during the parliamentary recess and election season, which has meant that putting together a team of seven MPs, who are currently involved in intense election campaigning in all nine provinces, was not going to be an overnight exercise," Sizani said.<br />
<br />
Here are the names that the ANC submitted for the committee:<br />

Cedric Frolick (National Assembly house chairman);<br />
Buti Manamela (ANC whip on labour portfolio committee);<br />
Doris Dlakude (ANC deputy chief whip);<br />
Joyce Moloi-Moropa (chairwoman on public service and administration portfolio committee);<br />
Cecil Burgess (chairman on joint standing committee on intelligence);<br />
Luwellyn Landers (chairman on justice and constitutional development portfolio committee); and<br />
Faith Muthambi (ANC whip on communication portfolio committee)<br />

The DA has indicated that it wants an extension and will approach parliament on this. This is contradiction on DA's part as it has been claiming that the Anc is causing unnecessary delay. Some have labelled the DA as confused and dishonest in its election campaign.<br />

In a very surprising move, DA leader -Helen Zille and Agang leader - Mamphela Ramphele are in agreement that there is a need for unity against the Anc. Previously, these two female leaders entered into a very short-lived agreement that would see Ramphele become DA's presidential candidate.<br />

Yesterday they both appear publicly for the first time after their arrangement failed in just less than a week. It was surprising though that they appeared to be in harmony and agreed on a number of issues during election debate. <br />

It was yet another tough day for Oscar Pistorius in court today. He found himself under severe attack by state's prosecutor, Gerri Nel. It looks like the decision to have Oscar taking a stand has worked against him and his defence.</div>

The basis of the public protector’s findings that the president violated the Constitution and the ethics code and was liable to repay some of the costs of the Nkandla Project has no legal foundation.<br />
<br />
Her report is premised on what she claims to be the overarching constitutional duty of the president to protect state resources. According to her, the president’s failure to discharge this duty constituted a violation of paragraph 2 of the Executive Ethics Code, the Code, and amounted to conduct that is inconsistent with his office as a member of cabinet, as contemplated by section 96 of the Constitution.<br />
<br />
The president’s failure to protect state resources, according to her, also constituted the legal basis for the finding that the president and his family benefitted from the non-security related expenditure and he is therefore liable to repay part of the costs.<br />
<br />
In support of her findings, at her press statement incorrectly cites section 140 and the Presidential Oath in schedule 2 of the Constitution as imposing a duty on the president to protect and promote the rights of all people within the republic. Neither section 140 of the Constitution nor the oath contains the words she quotes. Based on that incorrect citation, she made a finding of unconscionable conduct on the part of the president.<br />
<br />
In her press statement she said: “Our government is the potent, the omnipresent teacher. For good or for ill, it teaches people by example – If the government becomes a law breaker, it breeds contempt for law, it invites every man to become a law unto himself,” without acknowledging the source. The quote actually comes from the 1928 US case of Olmstead v US which deals with improperly obtained evidence by state agencies in a criminal matter and is quoted out of context.<br />
<br />
She provides three further grounds to support her findings; that the president was wearing two hats – that of the ultimate guardian of the resources of the people of South Africa and that of being a beneficiary of state resources, but failed to discharge his responsibilities in terms of the latter, that the president should have asked questions regarding the scale, cost and affordability of the Nkandla Project and that the president failed to act on a newspaper article in 2009 relating to the cost of the project.<br /><script async src="//pagead2.googlesyndication.com/pagead/js/adsbygoogle.js"></script>

Her report conveys the view that the president – as the ultimate guardian and beneficiary of public power and state resources failed to discharge his constitutional duty arising from her version of section 140 to protect state resources and he failed to question the costs of the Nkandla Project.<br />
<br />
Section 140 of our Constitution deals with the executive decisions of premiers. In fact, there is no provision in our Constitution which imposes a constitutional duty on the president to protect state resources. All three of her findings fall to be set aside because the constitution does not impose a legal duty on the president to protect state resources.<br />
<br />
Section 2 of the code expressly provides that it must include provisions requiring cabinet ministers, including the president, to meet obligations imposed on them by law. The code requires wilful conduct on the part of a wrongdoer before action and sanction can follow.<br />
<br />
Consequently, if the president did not have a constitutional duty to protect state resources, it follows that he did not fail to discharge any obligation imposed by law as required by the code or the Constitution and did not violate the code.<br />
<br />
It also follows that if the finding of unconscionable conduct, which was premised directly on the president’s failure to protect state resources, falls to be set aside, then any inquiry into the president’s conduct contemplated by section 96 of the Constitution becomes irrelevant because the president did not violate the code.<br />
<br />
Another issue to be considered is whether the president had a legal duty to question the costs of the Nkandla Project. The answer to this will also determine whether the president was obliged to repay any costs.<br />
<br />
The Cabinet Protocol of 2003, the Protocol, provides for a security assessment to be made by the SAPS and the National Intelligence Agency. Thereafter, the Department of Public Works costs and executes the project.<br />
<br />
The purpose of the protocol is to safeguard the president, deputy president and former presidents and deputy presidents at their private residences. It is a public interest determined by cabinet, paid for with public funds and executed by government agencies. It is obvious that the implementation of the protocol will yield incidental private benefits for the recipient.<br />
<br />
<br />
In her interpretation of the 2003 protocol, the public protector defers to the current fiscal climate and the need to balance the competing wants of South Africa as a developing state and underpins the protocol with the element of affordability. The affordability concern may lie within her interpretation of morality, but was not a consideration or pre-condition imposed by the protocol itself.<br />
<br />
She makes reference to an article in the Mail and Guardian, which opined in December 2009 that the cost of the project was R65m. According to her, the newspaper article should have triggered a duty on the part of the president to act. If one assumes that the president read the article, the next inquiry would be whether the president had a moral duty or legal duty to act. The president’s constitutional duty to protect state resources has been dealt with above. The opinions expressed in a newspaper article cannot be said to legitimately fall within the legal framework that would give rise to a legal duty on the part of the president to act.<br />
<br />
That leaves open the moral duty. Morality is subjective. Even if one assumes that the president had a moral duty to act and failed to do so, would that be a basis to find that the President acted unconscionably or unethically in terms of the legal requirement of the code? To answer this question, one would have to straddle the interplay between legality and morality. Whatever the finding, it would have no basis in law.<br />
<br />
The public protector seems to have overlooked her own statutory responsibility set out in section 7(1) of the Public Protector Act on the presumption that she also read the article in the Mail & Guardian in 2009 to initiate an investigation to stop maladministration.<br />
<br />
The entire process of upgrading the security at the private residence of the president was within the control of the Department of Public Works.<br />
<br />
After the project was completed, it transpired that non-security related items – a kraal, chicken run, visitors’ centre, amphitheatre, swimming pool and extensive paving were built with public funds and were not part of the security upgrade. The accountable party throughout was the Department of Public Works and not the president.<br />
<br />
The finding that the president is liable to pay because he tacitly accepted the non-security related items and benefitted financially cannot constitute a basis in law to make him liable. The public protector made this finding on the grounds that the non-security related items cannot conscionably be accepted as security measures. In the absence of any legal basis, the public protector had no option but to fall back on morality.<br />
<br />
Her findings are fatally flawed. In effect, what the public protector has done is to impose an overarching but non-existent constitutional duty on the president to protect state resources and then proceed to shoot down her proposition to support the findings.<br />
<br />
The lesson going forward is that the exercise of a public function for the public benefit should be done in a clinical manner and within a defined legal framework and should not succumb to the temptation of automatically translating moral reprehension into illegality.<br />

President Jacob Zuma has finally broken his silence on Nkandla upgrades. This follows the release of the Public Protector, Advocate Thuli Madonsela. Read his full reply below:<br />

I refer to the above matter as well as the recent report received by me from the Public Protector of the Republic of South Africa, a copy of which is attached for ease of reference.<br />
<br />
Upon my assuming office as President of the Republic, Cabinet through its Security Cluster Ministers conducted a security assessment at my private residence at Nkandla, in course of which certain security upgrades were commissioned. This is the norm in respect of all incoming Heads of State in the Republic. In addition, my family had already commenced construction work with a view to improving the same property.<br />
<br />
For some time government had been concerned by allegations of maladministration and excessive expenditure in relation to these security upgrades. A preliminary investigation conducted by the Department of Public Works found that the matter was deserving of a full investigation.<br />
<br />
The Ministers in the Security Cluster were instructed to launch a full investigation into the needs assessment and analysis, procurement and implementation of the security upgrades as my residence. To this end, a multi-disciplinary Task Team comprising of senior government officials, with the oversight of the Security Cluster Ministers, were tasked to conduct an in debt [sic] investigation.<br />

Their report has been finalised and presented to me and I am aware that Parliament has been favoured with the same.<br />
<br />
The Report adopts a particular methodology, appreciation and interpretation of the relevant legislation and contains findings and recommendations on remedial action.<br /><script async src="//pagead2.googlesyndication.com/pagead/js/adsbygoogle.js"></script>

Subsequently, the Public Protector engaged in an investigation into the same security upgrades, the terms of reference being apparent from the report itself. The report reveals the extent to which the Public Protector engaged with the Ministers of the Security Cluster, senior government officials, government security experts, private individuals and indeed myself.<br />
<br />
This report adopts a particular methodology, contains certain findings and recommends remedial action to me taken by inter alia myself as President and the various Ministers.<br />
<br />
During the course of December 2013, I caused a proclamation to be gazetted which empowers the Special Investigating Unit (SIU) to enquire into and investigate the security upgrades at Nkandla. I enclose a copy of the gazette which details the terms of reference.<br />
<br />
Exercising my powers in terms of Section 4(1)(f) of the Special Investigating Unit and Special Tribunals Act of 1996, I have written to the Head of the SIU requesting a provisional report in order that I may be appraised of the status of the investigation and to assess whether the investigation is proceeding expeditiously.<br />
<br />
I have received an acknowledgment of my correspondence from the SIU and I am assured that the provisional report will be ready to hand shortly.<br />
<br />
In the conspectus of these interventions Mr Speaker, I must apply my mind as to the appropriate action to be taken, remedial and otherwise.<br />
<br />
I am keenly aware of my status as Head of State as set out in Section 83 of the Constitution of the Republic of South Africa as well as the concomitant responsibilities to which I am enjoined in terms of the same constitution. So too am I aware and recognise the accountability to Parliament which I share both individually and collectively with my Cabinet in the performance of my responsibilities and oath of office.<br />

On an appraisal of the matters before me, it is apparent that<br />
<br />
1. the Security Cluster Ministers cooperated in the Public Protectors’ investigation;<br />
<br />
2. both the investigation by the Security Cluster Ministers and the Public Protector enquired into substantively the same subject matter.<br />
<br />
3. the Security Cluster Ministers, the Public Protector and the SIU all have a constitutional and legislative mandate to conduct their respective investigations;<br />
4. a considerable amount of state resources have been expended in the conduct of all investigations and the compilation of reports.<br />
<br />
Notwithstanding, there are stark differences both in respect of the findings as well as the remedial action proposed in the two reports. This much is clear from the reports as well as very public pronouncements made by the respective parties. In my experience in government I have not encountered such an anomaly.<br />
<br />
Mr Speaker, I am intent on giving full and proper consideration to all these matters and upon receipt of the SIU report will provide Parliament with a further final report on the decisive executive interventions which I consider would be appropriate.<br />

It is alleged that President Jacob Zuma has received numerous letters from organisation and individuals asking him to act against what is dubbed as a propaganda championed by some formations obsessed about the so called ‘spy tapes’. <br /><br />These letters have revealed that there is a growing concern about some media organisations spreading lies about what transpired in relations to spy tapes.<br /><br />It is alleged that the DA has been lobbying for financial support to carry out its High Court application to have spy tapes released. What concerns many that this is a political plot led by the DA to damage the reputation of some individuals including President Zuma.<br /><br />It appears that many people are upset by the fact that the DA is well aware of legal processes and is acting as if they don’t know that the tapes form part of Zuma’s confidential representations and these cannot be released for the public.<br /><br />“It is very misleading for the DA and friends to claim that the content of the tapes is not know. These tapes are still in the hands of the NPA and prosecutors were given a chance to listen to these tapes”, said one senior media official. <br />“The NPA is thus confident that its decision is based on information that was intercepted legally and obtained legally by the NPA,” Mpshe said. But Kemp J Kemp, argues that the fact the tapes were obtained from the NIA – which the DA is relying on in order to get its hands on the full transcripts – was irrelevant.</div>

He reminded the DA of what happened when it pushed the floor crossing legislation which ended up working i favour of the Anc. Read his full statement:<br /><br /><b>Debate On Electoral Reform</b><br /><br />The Office of the ANC Chief Whip notes the ongoing debate in the media in relation to South Africa's electoral system. This is not a new debate. At the heart of this media debate is whether a constituency or proportional representation system better serves democracy. Regrettably, those who have recently resuscitated this debate have entered into it from a narrow and populist perspective, and are guilty of deliberate distortion and overlooking the complexity of the subject of electoral reform. <br /><br />A debate as critical to the future of our constitutional democracy as this requires those who advance it to do so responsibly, honestly and informatively. An impression has been created that a change of an electoral system is a panacea to the challenge of accountability which some believe our constitutional democracy currently faces. Some have even absurdly suggested that the current electoral system is undemocratic and unrepresentative, and therefore a solution lies in a different one. If one was to remove the noise, propaganda, lies and dishonesty from the debate on electoral reform, the naked reality remains that a different electoral system is no panacea. <br /><br />The ANC adopted the current proportional representative (PR) system after 1994 because we wanted an inclusive system that is representative of minority views, in the interest of an inclusive transition. The PR system has facilitated representative institutions with a special focus on women, rural communities and other targeted groups such as people living with disabilities, the elderly and youth. The PR system is accommodative of even smaller parties, thereby ensuring participatory democracy. The ANC 50/50 gender representation policy, for instance, is made possible through the current system. The system allows for fair representation and gives a voice to all.<br /><br />Those who have advocated for a change to the Constituency system have consistently ignored its associated disadvantages to representative and participatory democracy. <br /><br />This system, in which parties and independents nominate candidates for each of 400 constituencies and the candidate who gets the most votes wins the seat, will result in the replacement of the current multiparty system with a two-party system. Contrary to the arguments of its proponents, it does not guarantee improved accountability. Improved accountability, which is a critical feature of democracy, is not dependent solely on an electoral system. <br /><br />Ironically, proponents of the system change such as the DA have no constituency offices through which MPs regularly interact with communities, as required by Parliament. It is a common occurrence for DA MPs to stay away from oversight visits of portfolio committees taking place in rural villages and townships. They would rather interact through the media from the comfort of their air-conditioned offices than be visible amongst constituencies. Such kind of unaccountability cannot be addressed by a change in electoral system.<br /><br />With over 260 offices spread across the country, the ANC continues to view constituency work as the backbone of its parliamentary programme.<br /><br />Our reflection on this subject is neither intended to discourage the raging debate nor to demonstrate hostility to electoral reform, but to ensure honesty, openness and sincerity. <br /><br />The ANC was previously pressured to accept the floor-crossing legislation, whose proponents in the opposition argued that it served our democracy. This was intended to dislodge the majority party and weaken it. When the legislation turned out to benefit the majority party more than those who campaigned for its enactment, they made a u-turn and demanded its withdrawal. The current debate on electoral reform smacks of the same motives. The agenda of those who advance this debate based on less than honourable motives shall collapse. Our people are not gullible. </div>

<i><b>Breaking News South Africa </b></i>- Independent Police Investigative Directorate has confirmed that all eight police implicated in the killing of a taxi driver have been arrested. They are scheduled to appear in Daveyton Magistrate's Court on Monday.<br />

"The suspects will remain in custody until they appear in court. The Ipid is committed to ensuring that the suspects are held accountable and brought before the courts," said IPID spokesman Moses Dlamini. <br />
<br />
Earlier during the day, the National Police Commissioner had suspended all police officer involved in the violent incident that resulted in death of Mido Macia. The brutal incident was caught on camera and made headlines across South Africa yesterday.<br />
<br />
Phiyega also removed the station commander of Daveyton Police Station in order to allow investigation to proceed without interference. In her statement, angry Phiyega said:<br />

"The SAPS management regrets the incident that led to the death of Mr Mido Macia and we would like to assure the country and the world that, that what is in the video is not how the SAPS in a democratic South Africa goes about its work.<br />

I have therefore, instructed the Acting Provincial Commissioner of Gauteng Province, Major- General Gela to immediately suspend all policemen that were involved in the incident. I have also instructed that the officers involved be disarmed. Further, I have instructed that an internal investigation in terms of the SAPS disciplinary procedures be initiated immediately. We are also removing the current Station Commander of Daveyton Police Station from his position so that investigations can proceed uninhibited," said Phiyega.</div>

The Independent Police Investigative Directorate is already busy with its investigation in regards to the matter. I would like to assure the IPID and the country that the SAPS, will give IPID any support it needs in order for them to conduct their investigation. As stated above, the officers will be suspended with immediate effect. The suspensions are intended inter alia, to enable IPID to conduct its investigation unhindered and without any hindrance from any quarter." <br />
<br />
Many organizations and analysts have welcome this move by the Police Commissioner and have applauded her for displaying courage. She is committed in restoring the reputation of the <a href="http://www.saps.gov.za/" target="_blank">SAPS</a>.</div>
